LUCAS DENNEY PLEADS GUILTY TO SINGLE CHARGE AFTER GOV VIOLATES HIS RIGHTS

Lucas Denney of Mansfield, Texas pled guilty to a single charge of assault on a federal law enforcement officer while he was attending the protests at the U.S. Capitol on January 6, 2021.

Denney admitted that he picked up a length of PVC plastic pipe off the ground and swing it at an Officer in attempting to knock the pepper spray device from the Officer's hands.

By pleading guilty without an agreement, Denney maintains the right to contest all the issues relevant to sentencing and to appeal any issues which he believes are wrongly decided.

In Plea Agreements entered into by other defendants with the government, those defendants have been forced to agree to certain facts and sentencing enhancements, and then forced to waive their rights to appeal those issues in a "take it or leave it" fashion.

For Mr. Denney, the government will now be forced to prove some or all of those same enhancements actually apply to January 6 cases, depending on the nature of the charges. The government has prevented this type of inquiry in the manner in which it has gone about resolving other cases to date.

Judge Randolph Moss scheduled June 9, 2022, as the date for Mr. Denney's sentencing.
